Hazardous Materials Guide
Listed in NASA Earthdata CMR
Authorities: 42 U.S.C. 6901 et seq.: Resource Conservation and Recovery Act; 40 CFR 265: Solid Waste; M.G.L. c. 21C, 4, 6 and M.G.L. c. 21E: Hazardous Waste Management Act; 31 CMR 30.000: Hazardous Waste Regulations.
Description
Jurisdiction: Handling, transporting, and disposing of hazardous materials in Massachusetts. Applicability: Projects that generate hazardous materials must store and dispose of them in compliance with Resource Conservation and Recovery Act (RCRA) requirements.
Regulatory The Massachusetts Department of Environmental Protection (MassDEP) administers the Hazardous Waste Management Act M.G.L. Ch. 21C and its implementing regulations 31 CMR 30.00, which are more stringent than the RCRA hazardous material handling requirements. Massachusetts regulates the collection, transportation, separation, recovery, and disposal of solid and hazardous materials. Hazardous materials are defined as ignitable, corrosive, reactive, and/or toxic.

Regulatory requirements for shipping and storage differ, depending on the amount and type of hazardous material generated. All generators of hazardous waste are responsible for its proper disposal. RCRA requires a national "cradle to grave" tracking system for hazardous waste.
In Massachusetts, every shipment of hazardous waste by a large or small quantity generator must be transported by a licensed hauler and sent to a licensed treatment, storage, or disposal facility, or a permitted recycling facility, and must be accompanied by a Uniform Hazardous Waste Manifest. A list of requirements for storage, handling, and shipping is included in A Summary of Requirements for Small Quantity Generators of Hazardous Waste, available from DEP.
Review Process: Review applies to licensed haulers and treatment, storage, or disposal facilities. Forms: Uniform Hazardous Waste Manifest, available from licensed haulers. Fees Determined by licensed hauler.
