The judicial and legal role of the Lord Chancellor of Ireland 1852 to 1922

The Lord Chancellors of Ireland from 1852 to 1922 occupied a unique politico-judicial role in the governance of Ireland.

Description

They were the most senior judges in the Irish administration, with wide-ranging roles and responsibilities within the political and judicial sphere that varied over time. A prosopographical approach is combined with an historical analysis in this thesis which provides background and context to a doctrinal analysis of case law and legislative debates.

Through these methods, the Lord Chancellors are analysed as agents of change and continuity, with specific focus on their activism and restraint, experience, and ideology as influences. The Lord Chancellors contributed to major legal changes in Ireland. These included their role in their own department, the appointment of magistrates, the operation of the Judicial Committee of the Irish Privy Council, and judicial and court reform.

They played a key role in the development and reform of Irish land law, and the Irish law of equity and trusts. Additionally, they had a significant place in the Irish application of UK-wide laws relating to economic and industrial development.As agents of continuity and change, the Lord Chancellors’ contribution and impact was significant. They acted with a variety of activism and restraint in various aspects of their role.

As activists, O’Hagan and Ashbourne handled reforming the courts and land law through legislative activity. In terms of judicial decisions, others tended to be more restrained when seen through the lens of the separation of powers doctrine and/or judicial independence. Not being professional judges in origin, they benefited and/or were handicapped by a wide variety of experience, judicial and otherwise.

The influence of their ideology, while often difficult to attribute directly was of importance but cannot be categorised as jurisprudential. Although often neglected and/or dismissed, the Lord Chancellors mattered when in office.<br><br><i>Thesis is embargoed until 31st July 2030.</i>
